Welcome to Berara Design, operated by Berara Pty Ltd (“Berara Design”, “we”, “us” or “our”).

These Terms & Conditions govern your use of beraradesign.com.au, your purchase of products from us, and your use of the services we provide.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer and sell our products online.

By accessing our website, placing an order, requesting a quote, purchasing a sample, or otherwise using our services, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable Australian laws.

1. About Berara Design

Berara Design supplies architectural products for residential and commercial projects, including:

Outdoor WPC wall panels;
Acoustic slat wall panels;
Flexible acoustic panels;
SPC marble sheets;
Panel installation accessories;
Adhesives;
Solar wall lights; and
Other related architectural and decorative products.

Our products are available in various colours, finishes, sizes and specifications depending on the product range and current stock availability.

2. Online Store & Acceptance of Orders

Products displayed on our website are subject to availability.

Placing an order through our website constitutes an offer to purchase the selected products.

After an order is submitted, you may receive an automated order acknowledgement or confirmation through Shopify. We reserve the right to review an order before accepting or fulfilling it, including where there is:

A pricing or product-description error;
Insufficient stock;
A suspected fraudulent transaction;
A delivery limitation;
An obvious quantity or technical error; or
Another reasonable issue preventing us from fulfilling the order.

If we cannot fulfil an order after payment has been received, we will contact you and provide an appropriate solution, which may include a refund.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, measurements, images and other information displayed on our website are accurate.

However, minor variations may occur.

Before purchasing, customers should review the relevant product specifications and confirm that the selected product is suitable for their intended project.

If you require clarification about a product, please contact Berara Design before placing your order.

4. Colours, Patterns & Natural Variations

Many of our products are designed to replicate or complement natural materials such as timber, stone and marble.

As a result, reasonable variations may occur in:

Colour;
Grain;
Pattern;
Texture;
Shade; and
Finish.

There may also be variations between different production batches.

Product photographs and digital representations are provided as a guide. The appearance of colours and finishes may vary depending on photography, lighting conditions and your device or screen settings.

Where colour or finish is particularly important to your project, we recommend purchasing a sample or viewing the product in person before placing a larger order.

5. Samples

Berara Design offers sample options for selected indoor and outdoor panel ranges.

Our current sample offer may be displayed on the website from time to time, including promotional or discounted sample pricing.

Where a sample promotion states that the purchase price of a sample is redeemable or credited toward a subsequent qualifying order, the applicable conditions displayed with that promotion will apply.

Samples are intended to help customers assess product colours, textures and finishes before purchasing full-size products.

Please note that reasonable variations may occur between samples and full-size products or between different production batches.

6. Pricing

All prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.

Prices, promotions and discounts may change from time to time.

The price applicable to your purchase will generally be the price displayed and confirmed at checkout at the time your order is placed, subject to correction of obvious errors and applicable law.

Delivery charges and any other applicable charges will be displayed or communicated separately where relevant.

If we identify an obvious pricing error before fulfilling an order, we will contact you and provide appropriate options, which may include paying the correct price or cancelling the affected order for a refund.

7. Promotions & Discounts

From time to time, Berara Design may offer:

Promotional prices;
Percentage discounts;
Sample promotions;
Discount codes;
Clearance pricing;
Trade pricing; or
Other special offers.

Promotions may be subject to specific eligibility requirements, products, quantities, dates or other conditions disclosed with the promotion.

Unless otherwise stated, promotional offers cannot necessarily be combined with other discounts or offers.

8. Trade & Bulk Pricing

Berara Design may offer special pricing to:

Builders;
Installers;
Tradespeople;
Designers;
Commercial customers; and
Customers purchasing larger quantities.

Trade and bulk pricing may depend on the product, quantity, availability and overall order value.

A trade or bulk quotation is subject to the conditions specified in that quotation and does not necessarily apply to future purchases.

9. Payment

Payment must be made using one of the payment methods available through our Shopify checkout or another payment method expressly agreed with Berara Design.

Orders may not be released, collected or dispatched until the required payment has been successfully received or otherwise agreed.

Payments processed by Shopify or other third-party payment providers may also be subject to the terms and privacy policies of those providers.

10. Order Changes & Cancellations

If you need to change or cancel an order, please contact Berara Design as soon as possible.

We will make reasonable efforts to assist.

However, once an order has been prepared, dispatched, collected, specially ordered or otherwise committed for fulfilment, cancellation or modification may not always be possible.

Where an eligible cancellation constitutes a change of mind, our Returns, Refunds & Replacement Policy may apply.

Nothing in this section limits rights available under Australian Consumer Law.

11. Delivery Areas

Berara Design currently offers delivery to selected areas across:

Sydney;
Central Coast; and
Newcastle.

Delivery availability outside these areas may be considered on request.

Delivery charges depend on factors including:

Delivery location;
Order quantity;
Product dimensions and length;
Weight;
Access requirements; and
Transport requirements.

Please provide your suburb and order details if you require a delivery quote.

12. Delivery Schedule

Our regular scheduled delivery days are Tuesdays and Fridays.

Weekend delivery is not currently available.

Delivery dates and timeframes provided by Berara Design are estimates unless expressly confirmed otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including transport delays, traffic, weather, supplier delays or other logistical issues.

If a significant delay occurs, we will take reasonable steps to communicate with you and provide an appropriate solution where required.

13. Delivery Access

Customers are responsible for providing accurate delivery information and reasonable access to the delivery location.

Before delivery, please advise us of any circumstances that may affect delivery, including:

Restricted access;
Narrow streets or driveways;
Apartment or building access restrictions;
Stairs;
Loading restrictions;
Construction-site restrictions; or
Other unusual access conditions.

Additional charges may apply where additional transport or handling is reasonably required because relevant access information was not disclosed before delivery, provided those charges are communicated appropriately.

14. Receiving & Inspecting Your Order

We strongly recommend inspecting your products as soon as reasonably possible after receiving them and before cutting, drilling, modifying or installing them.

Please check:

Product type;
Colour;
Finish;
Size;
Quantity; and
Visible condition.

If you believe your order is damaged, incorrect, faulty or incomplete, please contact Berara Design promptly and provide your order details and supporting photographs where appropriate.

Inspecting products before installation helps us assess and resolve issues efficiently.

15. Returns, Exchanges & Change of Mind

Berara Design offers a 14-day voluntary change-of-mind return period for eligible products.

Customers must contact us within 14 days of receiving their order.

To qualify for a change-of-mind return, products must generally be:

Unused;
Uninstalled;
Uncut;
Unmodified;
Undamaged;
In their original packaging; and
In resalable condition.

For change-of-mind returns, colour changes or customer-requested exchanges, applicable delivery and transportation costs are the customer’s responsibility.

The 14-day change-of-mind period is an additional benefit provided by Berara Design and does not limit your rights under Australian Consumer Law.

16. Faulty, Damaged or Incorrect Products

If a product arrives damaged, is faulty, is materially different from what was ordered, or otherwise fails to meet an applicable consumer guarantee, please contact us.

Where appropriate, we may request:

Proof of purchase;
Photographs or videos;
Photographs of packaging;
Product information; and
Details of the issue.

Berara Design will assess the matter and provide an appropriate remedy in accordance with Australian Consumer Law.

Where Berara Design is responsible for reasonable transportation, collection or replacement delivery costs under Australian Consumer Law, those reasonable costs will be covered by Berara Design.

17. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.

18. Product Quantity & Panel Calculator

Berara Design may provide:

Online panel calculators;
Quantity guides;
Social media calculation guides;
Staff-assisted calculations; and
General product quantity recommendations.

These tools and calculations are provided to assist customers in estimating quantities.

The quantity required for a project can vary depending on factors including:

Actual site dimensions;
Installation direction;
Cutting;
Corners and openings;
Pattern alignment;
Installation method;
Site conditions; and
Wastage.

Customers and/or their installers should verify measurements and final quantities before ordering.

Where you provide measurements to Berara Design, our calculations are based on the measurements and information supplied by you.

Nothing in this section excludes any responsibility that cannot lawfully be excluded under Australian Consumer Law.

19. Installation

Many Berara Design products may be suitable for DIY installation where the customer has appropriate skills, tools and experience.

Installation information or guides provided by Berara Design are intended as general guidance.

Customers are responsible for ensuring that installation is appropriate for their property, substrate and intended application and complies with applicable building requirements.

For complex installations, high walls, ceilings, exterior applications or where you are uncertain about installation, we recommend obtaining appropriate professional assistance.

20. Independent Installer Referrals

Berara Design does not directly provide installation services unless expressly stated otherwise.

At a customer’s request, we may refer a project to one or more independent installers.

To arrange a referral, we may request:

Your name;
Contact number;
Project address;
Photos of the project;
Measurements, if available; and
Relevant project information.

Independent installers may contact you directly and provide their own quotations.

You are free to compare quotes and decide which installer, if any, you wish to engage.

Unless expressly stated otherwise, independent installers are not employees, agents or subcontractors of Berara Design, and any installation agreement is entered into directly between the customer and the chosen installer.

Berara Design does not set the installer’s final quotation or control the performance of independently contracted installation work.

This does not exclude any responsibility Berara Design may have under applicable law.

21. Adhesives & Installation Accessories

Berara Design sells selected adhesives, trims and installation accessories for various products.

The appropriate accessories may depend on the:

Product;
Substrate;
Installation location;
Installation method; and
Site conditions.

Any general recommendation provided by us is based on the information supplied by the customer.

Customers and installers should check product instructions and suitability for the specific application before installation.

22. Product Suitability

Customers are responsible for selecting products suitable for their intended project and environment.

Where you tell us about a specific intended use and rely on our recommendation, applicable consumer guarantees may apply.

For projects involving specialised building requirements, structural considerations, waterproofing, fire requirements, building approvals or other regulated requirements, customers should obtain appropriate professional advice before purchasing or installing products.

23. Solar Lighting Products

Solar lighting performance may vary depending on environmental and installation conditions, including:

Available sunlight;
Panel orientation;
Shading;
Weather;
Season;
Battery condition; and
Installation location.

Product-specific specifications and instructions should be reviewed before installation and use.

Nothing in this section limits any consumer guarantee applicable to the product.

24. Website Information

We make reasonable efforts to keep information on our website accurate and current.

However, product ranges, stock availability, colours, specifications, prices and promotions may change.

Website content is provided for general product and purchasing information and should not be treated as professional architectural, engineering, structural or building advice.

25. Website Availability

We do not guarantee that our website will always operate without interruption or technical errors.

Shopify, payment providers, internet providers and other third-party systems may occasionally experience outages or maintenance.

We may temporarily suspend or modify website functionality where reasonably necessary for maintenance, security or operational purposes.

26. Intellectual Property

Unless otherwise stated, content displayed on the Berara Design website, including our:

Branding;
Logos;
Product photography;
Graphics;
Written content;
Installation guides;
Marketing materials; and
Website design elements

is owned by or licensed to Berara Design and is protected by applicable intellectual property laws.

You may use our website content for personal, non-commercial purposes associated with considering or purchasing our products.

You must not reproduce, republish, distribute or commercially exploit our protected content without permission.

27. Customer Reviews & Submitted Content

If you voluntarily provide Berara Design with a review, testimonial, project photograph or other content and give us permission to use it, we may use that content for reasonable promotional and marketing purposes consistent with the permission provided.

We will not knowingly publish customer content in a misleading manner.

If identifiable personal information is involved, our Privacy Policy also applies.

28. Privacy

Your privacy is important to us.

Personal information collected through our Shopify website and business operations is handled in accordance with our Privacy Policy and applicable Australian privacy laws.

29. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded under Australian Consumer Law or other applicable law.

To the extent permitted by law, Berara Design is not responsible for loss or damage caused by matters outside our reasonable control or by misuse, incorrect installation, unauthorised modification or use of a product contrary to applicable product instructions, except to the extent that Berara Design is legally responsible for that loss or damage.

30. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our:

Products;
Services;
Website;
Business operations; or
Legal obligations.

Updated Terms & Conditions will be published on our website with a revised “Last updated” date.

Changes will apply prospectively and will not remove rights that have already arisen under an existing order or applicable law.

31. Governing Law

These Terms & Conditions are governed by the laws applicable in New South Wales, Australia, subject to any rights or protections available under applicable Australian law.
